Family Based Immigration
One of the most sought after U.S. immigration benefit is obtaining permanent residence status.
One of the ways an immigrant can obtain a green card is through the marriage to a US Citizen.
We focus our family-based immigration practice on green cards for those married to U.S. Citizens. Because of the unfortunate amount of fraud in this process, marriage-based petitions are highly scrutinized by the USCIS.
The process to obtain a green card based on marriage involves several documents and steps including:
– Preparation and Filing Petition for Alien Relative and
– Preparation and Filing Adjustment of Status Application
The process also includes filing an Affidavit of Support. The petitioning spouse will have to prove to the U.S. Government that he or she will be able to financially support his/her immigrant spouse.
The immigrating spouse has to attend a biometrics appointment and you will both have to attend an interview.
Those couples who successfully petition the USCIS prior to their two-year marriage anniversary will receive a “conditional green card” which requires green card renewal later.
You should consider hiring an attorney to help you through this important process.
