Premium Processing Suspension for I-129 and I-140 Petitions

On March 20, 2020, USCIS temporarily suspended premium processing service for all Form I-129 and I-140 petitions until further notice due to the pandemic.

What If USCIS Already Accepted Your Request for Premium Processing? 

As of this writing, USCIS plans to continue with premium processing for those petitions that already have an accepted Form I-907, Request for Premium Processing Service. 

What About Other Premium Processing Requests in Progress?

For petitions mailed before March 20 that have not yet been accepted, USCIS will reject the request for premium processing and return the filing fee.

If you filed a Form I-129 or Form I-140 using the premium processing service and have received no agency action on your case within 15 calendar days period, you will likely receive a refund. 

When Will Premium Processing Resume?

We don’t know at this time. But we will update you as soon as USCIS notifies the public.

What Categories Does This Temporary Suspension Include?

  • I-129: E-1, E-2, H-1B, H-2B, H-3, L-1A, L-1B, LZ, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, R-1, TN-1 and TN-2.
  • I-140: EB-1, EB-2 and EB-3.
