In Maronda Homes, the Florida Supreme Court expanded the implied warranties of fitness and merchantability in construction litigation to include “offsite improvements” such as roads and water management systems. A statutory amendment while the litigation was pending, however, specifically excluded offsite improvements from the scope of the warranties.
