The Plaintiff, America’s CNG, LLC, alleges the City of Lake City was in breach of a contract that required the City to sell its natural gas for a period of ten years. The Plaintiff argued that the City refused to sell it natural gas or to comply with its obligations under the contract. As a result of the alleged breach, the Plaintiff claimed it had incurred over $12,500,000.00 in damages. Mr. Oldenburg defended the case on the grounds that there was not a valid contract (due to the omission of a signed non-compete provision), the Plaintiff failed to perform (or was not able to perform) its obligations under the contract, and that the Plaintiff did not sustain any damages as a result of the City’s conduct. At the conclusion of a nine-day jury trial in Lake City, Florida, the jury returned a defense verdict.
