H-1B Cap Season Update: Registration & Next Steps

We have officially begun H-1B cap registration for our candidates, and we are on track to complete all registrations before the end of registration – March 7-24

Our goal is to make this process as smooth, efficient, and stress-free as possible for employers and foreign workers alike.  We carefully evaluate each case to ensure it meets all H-1B criteria, provide guidance and gather the necessary documentation.

🛠️ Understanding the H-1B Cap Process

The H-1B Cap process consists of two key steps:

🔹 STEP 1 – REGISTRATION (Now in Progress!)

To complete H-1B cap registration, our team has:

  • Gathered & Evaluated Case Details – Ensuring each case meets eligibility criteria.
  • Verified O*Net categories, prevailing wages, work locations. 
  • Assisted Employers with USCIS Organizational Accounts, if needed.
  • Monitored and adapted to process changes and navigated electronic clutches. 
  • Drafted, Submitted and Paid Registrations and coordinated with employers for verification.
  • Tracked confirmations and follow-ups
  • Provided ongoing updates and guidance on various issues including travel, work authorization, documentation and more 
  • Prepared to monitor and wait for USCIS Lottery Results – USCIS will conduct the random selection process and announce results after March 31, 2025.

 Next Steps After Lottery Results:

  • If selected, we will confirm with the employer and proceed to Step 2 (H-1B petition preparation and filing).
  • If not selected, we will provide guidance and discuss contingency plans based on individual circumstances.

🔹 STEP 2 – FILING THE H-1B PETITION (For Selected Candidates)

For candidates selected in the H-1B lottery, we will:

  • Request Final Information and Documents – Gathering outstanding paperwork for the petition.
  • Prepare & File the H-1B Petition – We have 90 days after selection to submit petitions to USCIS.
  • Processing Timelines:
  • Regular Processing: USCIS typically adjudicates cases within 3-6 months.
  • Premium Processing: (Optional) Provides a decision within 15 business days for an additional USCIS fee of $2,805.   We’re recommending NOT to use premium at this time. 

🌟 Effective Date of Approved H-1Bs: Any approved petitions will take effect no earlier than October 1, 2025.
